1.1. Leistung der CLEVER&SPORTY Handels GmbH
Mit Ausfüllen der Informationsfelder und Abschluss des Buchungsvorganges beauftragt der Kunde die Clever&Sporty GmbH einen der dargestellten Verträge zu erfüllen. Der Kunde ist an seine Buchung gebunden.
Für Zusatzprodukte wie Skipässe und Skikurse: Die Clever&Sporty Handels GmbH tritt im Rahmen dieser Tätigkeit, die im Wege der Website www.cleverandsporty.com ausgeübt wird ausschließlich als Vermittler auf. Die Clever&Sporty Handels GmbH bietet für diese Produkte nur einen Einkaufsgutschein an, der ausschließlich in der Filiale der Clever&Sporty GmbH, Dorfstraße 78, 6450 Sölden einlösbar ist. Im Falle einer Skipass- oder Skikurs-Buchung kommt der Vertrag ausschließlich zwischen dem buchenden Kunden und dem jeweiligen Anbieter (Skiliftbetreiber, Skischule) zustande. Die Clever&Sporty Handels GmbH handelt im Namen und für Rechnung des jeweiligen Anbieters. Die nachfolgenden Bedingungen gelten daher ausschließlich für die Vermittlungstätigkeit und haben keinen Einfluss auf die Bedingungen zu denen die vermittelten Verträge erfolgen. Gerade im Hinblick auf Produkte anderer Unternehmen, behält sich die Clever&Sporty Handels GmbH das Recht vor, Preisänderung jederzeit an den Kunden weiterzugeben
1.2. Bepreisung & Rabatte
Die Preise für Materialmiete und Zusatzprodukte scheinen im Buchungsvorgang auf. Ein Abbruch des Buchungsvorganges ist zu diesem Zeitpunkt jedenfalls möglich. Die Preise verstehen sich inklusive aller zum Zeitpunkt der Buchung geltenden Steuern und Abgaben. Der Preis wird grundsätzlich in Euro verrechnet.
Im Falle der Buchung unter Verwendung eines Promotioncodes oder eines anderen von der Clever&Sporty Handels GmbH. zur Verfügung gestellten Rabattsystems gilt eine Höchstgrenze von maximal 35% Rabatt. Die Clever&Sporty Handels GmbH behält sich das Recht vor, eine abgeschlossene Buchung binnen 3 Tagen zu widerrufen, sollte ein Rabatt diese Höchstgrenze übersteigen.
1.3. Bezahlung
Der Preis kann mittels Kreditkarte, Paypal oder von einem anderen, von der Clever&Sporty Handels GmbH akzeptierten Zahlungsmittel entrichtet werden. Die Zahlung erfolgt zu 100% online: In diesem Fall wird der gesamte Buchungsbetrag bei der online Buchung bezahlt. Für den Fall späterer Nachbuchungen durch den Kunden ist die Clever&Sporty Handels GmbH. berechtigt, auch den durch die Nachbuchung entstandenen höheren Betrag einzuziehen bzw. das Kreditkartenkonto des Kunden hiermit zu belasten, oder Differenzbeträge vor Ort zu verrechnen.
1.3.1. Buchungsbestätigung
Mit Abschluss der Buchung bestätigt der Kunde die Richtigkeit seiner persönlichen Daten. Die vom Kunden getätigte Buchung gilt erst dann als angenommen, wenn er von der Clever&Sporty Handels GmbH eine Buchungsbestätigung erhalten hat. Der Kunde ist verpflichtet, die ihm zugegangene Buchungsbestätigung unverzüglich auf ihre Richtigkeit zu überprüfen. Abweichungen in der Buchungsbestätigung zur Buchung sind umgehend mitzuteilen.
1.4. Rücktritt, Stornierung
Eine Stornierung der Buchung ist schriftlich zu folgenden Bedingungen möglich:
1.4.1 Rücktritt vor dem ersten Buchungstag:
- Der Kunde kann sich durch Buchung der STORNOABSICHERUNG (Punkt 2) gegenüber der Zahlung einer Stornogebühr absichern.
- Erfolgt die Stornierung bis 10 Werktage vor dem ersten Miettag wird eine Stornogebühr von 15% des gebuchten Materials bzw. der gebuchten Leistung als Stornogebühr einbehalten.
- Erfolgt die Stornierung 9 - 4 Werktage vor dem ersten Miettag wird eine Stornogebühr von 25% des gebuchten Materials bzw. der gebuchten Leistung einbehalten.
- Erfolgt die Stornierung 3 oder 1 Werktag vor dem ersten Miettag, wird eine Stornogebühr von 50% des gebuchten Materials bzw. der gebuchten Leistung als Stornogebühr einbehalten.
1.4.2. Rücktritt ab dem ersten Buchungstag:
Keine Rückerstattung wird durch Clever&Sporty Handels GmbH gewährt, wenn der Kunde in Annahmeverzug gerät. Gleiches gilt, wenn der Kunde auf die Erfüllung des Vertrages frühzeitig verzichtet (Rückstellen des Leihmaterials vor Ende des Verleihzeitraumes, Abbruch des Skikurses vor Kursende, vorzeitige Abreise aus dem Hotel, etc.). Im Falle von Krankheit oder eines Unfalls kann der Kunde unter Vorlage einer ärztlichen Bestätigung vom Vertrag zurücktreten und erhält aliquot den bezahlten Miet- oder Skikurspreis zurückerstattet. Allfällige andere Vereinbarungen zwischen dem Anbieter und dem Kunden bleiben hiervon unberührt.
1.5.1. Abholung und Rückgabe der Ausrüstung
Der Kunde hat im Verleihgeschäft einen amtlichen Lichtbildausweis (z.B. Reisepass, Personalausweis oder Führerschein) sowie seine Buchungsbestätigung vorzulegen und erklärt sich einverstanden, dass von diesem Dokument eine Kopie angefertigt wird. Die Abholung der Ausrüstung ab 15:00 Uhr am Vortag des ersten Miettages im jeweiligen Verleihshop erfolgen (Ausgenommen hiervon sind 1 und 2 Tagesbuchungen bei Nachtskilauf). Die Rückgabe der Ausrüstung hat am letzten Tag der Mietperiode vor Geschäftsschluss zu erfolgen. Im Falle eine längeren Inanspruchnahme der Ausrüstung wird die Differenz zwischen der tatsächlich in Anspruch genommenen Mietdauer und der reservierten bzw. bezahlten Mietdauer zu den vor Ort üblichen Mietkonditionen berechnet und ist direkt vor Ort im Verleihshop zahlbar. Falls die gemietete Ausrüstung oder Teile hiervon nicht fristgerecht zurückgestellt wird, muss der Kunde mit der Verrechnung einer Nachgebühr rechnen. Die gemietete Ausrüstung hat in tauglichem Zustand zurückgestellt zu werden.
1.5.2. Umtausch
Ein Umtausch der gemieteten Ausrüstung vor dem ersten Miettag in eine höhere Kategorie ist möglich, wobei die Clever&Sporty Handels GmbH berechtigt ist, den durch die Umbuchung entstandenen Mehrbetrag einzuheben. Bei einem Umtausch in eine niedrigere Kategorie wird der Differenzbetrag zurückerstattet. In jedem Fall kann eine Umtauschgebühr durch die Clever&Sporty Handels GmbH verrechnet werden, es sein denn, diese Gebühr wurde bei der Buchung bereits verrechnet.
1.5.3. Gebrauch
Der Kunde ist für die gemietete Ausrüstung voll verantwortlich und hat sie entsprechend ihrer Funktion und Einsatzbedingungen pfleglich zu benützen. Hat die Ausrüstung bereits bei der Anmietung Mängel, so kann der Kunde Austausch verlangen. Die Weitergabe der Ausrüstung an Dritte ist nicht gestattet. Die Clever&Sporty Handels GmbH weist ausdrücklich auf die Risiken im Zusammenhang mit der Skibindungseinstellung bei unautorisiertem Tausch der Skier hin. Der Kunde hat dafür zu sorgen, dass die Ausrüstung so verwahrt wird, dass eine Verwechslung oder ein Diebstahl verhindert wird.
Skischuhe werden an die Skibindung angepasst, beide Mietgegenstände entsprechen den sicherheitstechnischen Vorgaben der ISO-Norm 11088. Im Zuge der Übergabe des Mietgegenstandes wird eine gesonderte sicherheitstechnische Überprüfung und Einstellung nach ISO-/ÖNORM jedoch nicht vorgenommen. Wir empfehlen jedoch allen Skimietern eine Sicherheitseinstellung (=elektronische Bindungsprüfung) gemäß ISO-Norm 11088 vor Ort durchführen zu lassen. Diese Einstellung benötigt vor Ort ca. 10 Minuten. Sollte der Mieter keine Sicherheitseinstellung vornehmen lassen, wird die Skibindung per Hand nach ISO-Zahl eingestellt. Für Unfälle aller Art wird keine Haftung übernommen, insbesondere haftet der Vermieter nicht für Schäden, die aufgrund einer falschen Angabe des Mieters – insbesondere im Zusammenhang mit der Bindungseinstellung - entstehen.
Persönliche Daten, die im Zuge der Geschäftsabwicklung angegeben werden, werden unter Beachtung der geltenden nationalen und europäischen Datenschutzvorschriften, zur Bearbeitung der Anfragen bzw. Online-Reservierungen verarbeitet und genutzt. Eine dauerhafte Speicherung und Nutzung der Daten für Marketingzwecke erfolgt mit der ausdrücklichen Zustimmung (im Zuge der Kundenregistrierung,…) des Mieters. Diese Zustimmung kann jederzeit und kostenlos widerrufen werden, z.B. per E-Mail an office@cleverandsporty.com.
1.5.4. Haftung durch den Kunden bei Bruch, Beschädigung oder Diebstahl
Die gemietete Ausrüstung ist nicht versichert. Bei Bruch, Beschädigung oder Diebstahl haftet daher der Kunde gegenüber der Clever&Sporty Handels GmbH für die Reparaturkosten bzw. den Zeitwert, es sei denn es wurde eine Haftungsübernahme (SCHUTZPAKET) durch die Clever&Sporty Handels GmbH vereinbart.
1.6. Gerichtstand
Für alle Rechtsstreitigkeiten im Zusammenhang mit oder in Bezug auf Skiverleih und Bnlinebuchungen auf www.cleverandsporty.com gilt ausschließlich Österreichisches Recht. Zuständig ist das sachlich in Betracht kommende Gericht für Sölden.
2. Stornoabsicherung
Die Clever&Sporty Handels GmbH bietet dem Kunden eine Stornoabsicherung für die Zeit bis zum ersten Miettag an. In diesem Zeitraum garantiert die Stornoabsicherung den Wegfall der Stornogebühren aus Punkt 1.6.1. Für diesen Service laufen Kosten in Höhe von 5% des Gesamtentgeltes der Buchung an. Die Stornoabsicherung kann nur mit dem Hauptvertrag über die Buchung abgeschlossen werden. Die Kosten sind in Vorhinein zu bezahlen und werden mit dem Buchungsentgelt bzw. der Anzahlung abgebucht. Im Fall des Abschlusses dieser Stornoabsicherung und einer Stornierung durch den Kunden hat die Clever&Sporty Handels GmbH das gesamte bezahlte oder angezahlte Buchungsentgelt zu erstatten. Transaktions- und sonstige Bearbeitungsgebühren sind davon nicht umfasst.
3. Risikobeitritt (SCHUTZPAKET) im Falle von Beschädigung, Bruch oder Diebstahl der gemieteten Ausrüstung
Hat der Kunde die Option SCHUTZPAKET gewählt, so gelten zusätzlich folgende Bedingungen:
- Mit Ausfüllen der Informationsfelder und Abschluss des Buchungsvorganges tritt die Clever&Sporty Handels dem Risiko des Kunden, für eine allfällige Beschädigung oder einen allfälligen Diebstahl des Materials von Verleiher in Anspruch genommen zu werden, bei.
- Der Kunde hat unverzüglich den Schaden mitzuteilen. Im Fall eines Diebstahls ist in jedem Fall die Vorlage einer polizeilichen Anzeige erforderlich, bei Nichtvorlage der polizeilichen Anzeige ist der Zeitwert des Mietgegenstandes zu ersetzen. Im Fall von mutwilligen Beschädigungen oder unsachgemäßer Verwendung hat der Mieter die Reparaturkosten zu zahlen, sollte eine Reparatur aus diesem Grund nicht möglich sein, ersetzt der Mieter den Zeitwert des Produktes. Unsachgemäße Verwendung stellt insbesondere auch die eigenmächtige Veränderung der Bindungseinstellung durch den Kunden dar.
- Die Clever&Sporty GmbH verrechnet für den Risikobeitritt (SCHUTZPAKET) eine Gebühr gemäß der aktuellen Preisliste. Die Gebühr ist im Vorhinein zu bezahlen und wird mit der Bezahlung oder Anzahlung abgebucht.
